What if my spouse hid income or assets?
Courts impute income when a party's records do not support the income claimed, and they charge a party for assets dissipated in contemplation of divorce. Where the concealment is deliberate the court can shift counsel and expert fees to the concealing party. The financial disclosure page explains the tools available.

Does my professional license or degree count as property?
Not anymore. Since January 23, 2016, DRL 236B(5)(d)(7) prohibits the court from treating enhanced earning capacity from a license, degree, celebrity goodwill, or career enhancement as marital property. The other spouse's contributions to your career remain a factor in dividing the rest of the estate. -
Will my spouse get half of my business?
Rarely. New York divides marital property equitably, not equally, and courts commonly award the non-titled spouse a minority share of a business the other spouse built and runs. The share depends on contributions and on the factors in DRL 236B(5)(d). Where the business is also the source of the maintenance the titled spouse will pay, the court must avoid counting the same income twice. -
How is a business valued in a divorce?
A neutral or court appointed expert values the business as of a date set by the court, usually the date the action was commenced for an actively managed business. The expert looks at normalized earnings, comparable sales, and the assets of the business, and applies discounts for lack of marketability and, where appropriate, for lack of control.
